Parents of Children Killed in Pool Drain Accidents Outraged By Federal Agency’s Rethink of Safety Law Consumer Product Safety Commission Weakens Law Intended To Make Pool Drains Safer, Critics Say

The decision by a federal agency to reinterpret a law meant to prevent deaths due to pool-drain accidents has outraged pool safety advocates and the parents of children killed by pool-drain suction.

Changing the cover of your pool’s drain could save lives.

“I was blown away,” said Nancy Baker, mother of a seven-year-old who died in 2002. “It’s sad that it will take more deaths to make them see the intent of the law.”

Baker and Karen Cohn, mother of a six-year-old who died in 2007, sent an angry letter to the Consumer Product Safety Commission (CPSC) after that agency recently voted to interpret the 2007 Pool Safety Act to no longer require back-up anti-entrapment systems in as many as 150,000 public and hotel pools and hot tubs.

“We urge you to reconsider and fulfill the intent of this important new law by installing the layers of protection that are required to mitigate-if not eliminate-incidences of drowning across this country,”

wrote Baker and Cohn. “There’s too much at stake.”

The vacuum effect in pool drains is powerful enough to hold swimmers, especially children, to the bottom of a pool. Contact between human skin and a flat pool drain can create suction equal to hundreds of pounds of pressure. In one horrific instance, four adult men were unable to pull a young girl from the grasp of a deadly drain. Swimmers can die from drowning or evisceration.

From 1999 to 2008, according to CPSC data, there were 83 reports of suction entrapment, including 11 deaths and 69 injuries. Experts say the number of deaths and injuries may be much higher, however, because police and medical records don’t always list specific causes for drowning.

Nancy Baker’s daughter Virginia Graeme Baker died in a tragic spa accident in 2002. The 7-year-old granddaughter of former Secretary of State James Baker died in her mother’s arms after she sat on the underwater floor drain of a hot tub.

Premier Aquatics has sent their newest service manager,  Myles McMorrow, to a public hearing on the Virginia Graeme Baker Pool and Spa Safety Act (commonly referred to as the VGB Act) at the Consumer Product Safety Commission headquarters in Bethesda MD..He was sent to be up to date on this new law that affects all public pools nation wide. Myles is no stranger to this new law. In the past he has testified before the CPSC on the technical wording of passages in the law and is an avid online pool safety blogger. He has been closely following this law for many years now.

 

     We here at Premier Aquatics firmly believe in this federal law and we are committed to insure that all our pools are up to code and safe. Once this law went into effect on December 19, 2008, we worked hard to update our customer’s pools and systems to comply. When it comes to pool safety in our mindset, there is no choice. We want to make every swimming experience a safe one. 

 

    The act was signed by President George W. Bush on Dec. 19, 2007, and went into into effect Dec. 19 2008. It is called the Virginia Graeme Baker Pool and Spa Safety Act, named after the granddaughter of former Secretary of State James Baker. She died after becoming stuck on the drain of a spa in 2002.  This is a federal law for all commercial pools and swim clubs to have new drain covers or SVRS * installed in all pools to meet the new code to prevent bodily injury and/or death. All covers and SVRS * must meet or exceed the  ASME/ANSI A112.19.8-2007 National Standards and ASTM G154 for UV Testing. This is stamped on all compliant covers and the law is regulated by the Consumer Product Safety Commission as well as state and local pool inspectors. All pools must have the new type of drain covers, which don’t easily create suction. Pools with just one drain must also install a second drain system or an external shut-off (SVRS). 

 

     The bill states that the maximum fine is $1.8 million and for pool closure until compliant with the law. National Swimming Pool Foundation officials said that some pool owners might have to spend up to $150,000 to update their drainage system. Thirty-nine children died from pool or spa suction between 1985 and 2004, according to Safe Kids Worldwide, a Washington-based nonprofit group.

*SVRS   stands for Suction Vacuum Release System : a piece of equipment that senses an entrapment and within a fraction of a second will turn off a pump system

As everyone knows, there has been some confusion as to the changes in Fairfax counties’ pool operator’s certification requirements. They have still not decided what they are going to do for this upcoming season. However, the good news is that they will honor any certification courses that are held before they make their decision. Therefore, we have scheduled an NSPF Pool Operators Certification Course to take place March 6th, 2010 from 8:00 am to 10:00 pm. This certification is a nationally recognized certification that does not expire for 5 years. This certification will be recognized in Alexandria, Fairfax, and Loudoun Counties. Prince William County will still require you to take this certification to the health department and pay for a Prince William Pool Operator’s card.

The cost of this NSPF course costs anywhere from $295.00 or more. For our lifeguards we are only charging $100.00 for the one day course. For anyone who would like to get certified that is not an employee of Premier Aquatics we are charging $295.00 for the course. Course Description:

Prepares lifeguard candidates in the skills and knowledge necessary to respond to aquatic emergencies, including First Aid and CPR for the Professional Rescuer with a focus on decision-making, escape techniques, and backboard techniques. Participants will study modules that teach AED, Preventing Disease Transmission, and Oxygen Administration for the Professional Rescuer.

Prerequisites: (skills MUST be completed prior to start of the course)

Candidate MUST be 15 years of age or older on or before the final scheduled date of course conclusion.

Must swim 300 yards CONTINUOUSLY (no stopping) using the following strokes in the following order:

1. 100 yards of front crawl (aka freestyle) using rhythmic breathing (to the side or front) and a stabilizing, propellant kick.

2. 100 yards of breaststroke using a pull (arm stroke), breathing, kick and glide in the proper sequence.

3. 100 yards of crawl or breaststroke or combination thereof.

Starting in the water, candidate swims 20 yards using either crawl or breaststroke – surface dives to 7-10 feet of water depth – retrieves 10 pound object – returns to the surface with the object – swims 20 yards to the starting point carrying the object on their chest using both hands while swimming on their back – places the object on deck and exits the water without assistance (no ladder or steps) – within 1 minute and 40 seconds. Time begins when participant leaves the starting point and ends when the candidate is in an upright standing position out of the water upon returning to the starting point.

Lifeguard - 15 years and older

Maintain a safe and clean pool environment, including but not limited to: watching the pool, enforcing the pool rules and cleaning the pool area and bathrooms. Full Time and Part Time positions available. $7.75 Starting Pay.

Requirements: Lifeguard Training/Community First Aid, CPR/AED for the professional rescuer, and guards 16 and older must also have their pool operators License.

Assistant Pool Manager – 16 years and older.

Maintain a safe and clean pool environment, including but not limited to: watching the pool, enforcing the pool rules and cleaning the pool area and bathrooms. Acting as the manager on duty when the Pool Manager is not there. Full Time and Part Time positions available. $8.00 starting pay.

Requirements: Lifeguard Training/Community First Aid, CPR/AED for the professional rescuer, and pool operators License.

Pool Manager – 16 years and older.

Maintain quality control of the pool grounds, including but not limited to, a clean and safe pool environment. Supervises lifeguards on duty. Communicates directly with area supervisors in order to maintain an excellent level of customer service. Full Time positions available. $9.00 starting pay.

Requirements: Lifeguard Training/Community First Aid, CPR/AED for the professional rescuer, and pool operators License.

Please note: You can be hired prior to taking your certification classes but all classes must be completed prior to Memorial Day weekend. Saturday, May 29, 2010.
